Feldman, Kleidman, Coffey, Sappe & Regenbaum LLP (FKCS&R), a Fishkill, New York-based law firm with clients throughout the Hudson Valley and Capital District, recently settled a long-standing law suit against the State of NY. The car accident occurred in Dutchess County, NY on a NYS highway, resulting in the death of a young mother (who left behind two young children and her husband). FKCS&R Partner Richard J. Coffey tried both the liability and damages trials, and attorney Marsha S. Weiss prepared the briefs following both trials. The Court of Claims found that NYS was responsible for the hazardous roadway conditions. While the verdicts were on appeal, Jeff Feldman was able to negotiate an $11.3 million dollar settlement.

The court found the state to be negligent in its maintenance of the road where the accident occurred, causing the death of a young mother. The plaintiff was awarded a $7.3 million judgment, as well as 9% interest from the time of death. The settlement, known as a structured settlement, of $11.3 million dollars will be disbursed to the children over a long-term period.
